Construction, Architecture and Engineering Claims and Disputes

Kay & Andersen is a well-known provider of legal services for the construction industry. We represent contractors, subcontractors, material suppliers, architects, engineers, owners, developers, governmental entities, construction managers, and owners’ representatives in disputes involving defective construction and design claims, construction errors and omissions, cost overruns, change orders, warranty claims, theft by contractor claims, delay claims, breach of contract, betterment, bond claims, wrongful termination, payment bond and performance bond claims, slander of title, fraud and misrepresentation, and lien filings and foreclosure. We appear on behalf of clients in arbitration proceedings and in trial and appellate court proceedings.

We also assist contractors and subcontractors with bidding disputes in public projects. When a contractor is denied a contract award because of a mistake in bidding instructions or a bidding error, the contractor needs to act swiftly to prevent the award of the contract to another party. We have assisted contractors with contesting erroneous bid awards due to errors in bidding instructions and bid errors. We represent contractors and subcontractors in disputes with the State of Wisconsin and other governmental entities (including the Department of Administration and municipal governments) in bid error cases, which include the seeking of injunctions as well as monetary damages.

We have substantial experience with design-build projects, fast track projects, and the traditional design-bid-build projects.
